Jurisdictional Issues

Crypto and Bitcoin are worldwide and so are the related legal issues. When a dispute arises involving cryptocurrency, the first issue that must often be weighed is “where can I resolve this issue?” The answer is often not so clear-cut.

The contracts often outline where a lawsuit must be filed and the steps that must be met before filing the lawsuit. These conditions precedent should be strictly complied with.

Often times, the contract will include an arbitration provision. An arbitrator is like a private judge who will resolve the case. In the realm of cryptocurrency, arbitration provisions may sometimes be beneficial as some issues involving crypto could leave a jury of non-crypto people scratching their head.
